E2 Treaty Investor Visa

Overview

The E-2 Treaty Investor Visa is a non-immigrant visa allowing citizens of treaty countries to work in the U.S. by investing in a business.

Requirements

  • Nationality: Must be a citizen of a country with a U.S. treaty.

  • Investment: Invest a substantial amount in a U.S. business, proportional to its cost.

  • Business Viability: The business must be a real, active commercial enterprise.

  • Control of Funds: Investor must control funds, which are at commercial risk.

  • Non-Marginal Business: The business must generate significant income or economic impact.

 

Quota

No fixed annual quota; approvals depend on eligibility and consular discretion.

Processing Time

  • Application: Consular processing takes 2-4 months; USCIS change of status takes 3-6 months.

  • Validity: Visa valid for 2-5 years, renewable indefinitely if requirements are met.

 

Steps

  1. Establish Business: Invest in or establish a qualifying U.S. business.

  2. File Application: Submit Form DS-160 (consular) or I-129 (USCIS) with supporting documents.

  3. Interview or Processing: Attend consular interview or await USCIS adjudication.

  4. Entry and Maintenance: Enter U.S. to manage business; maintain compliance for renewals.
